Obama's budget and the Equal Protection Clause
© ignoranceorapathy.com 02/25/2009
Just my thoughts on this subject.
Food for thought, doesn't our progressive tax code violate the Equal Protection Clause of the U.S. Constitution? By takiing more from one group of citizens and less from others and even giving money to some who have not earned it, out of the pockets of those who have, how does this provide equal protection for all citizens under the law?

Now follow me here because this is a stretch but I think one that should be discussed anyway.
The Fourteenth Amendment to the U.S. Constitution Section 1.
“…nor deny to any person within its jurisdiction the equal protection of the laws.”

Now here is the point, under the current progress U.S. Tax Code income taxes are assessed on a sliding scale according to your income level. Commonly know to us as Tax Brackets. The more you make the higher the percentage of your wage will be needed to pay your federal income tax liability. Not just the more you make the more you pay, but actually the more you make the higher the percentage is.
Low income people wont have any tax liability and will actually qualify for some of the federal welfare handouts known as tax credits, like the EIC or Earned Income Credit. (if you get money from the federal government that amounts to more than you paid in during the year, you are a welfare recipient)
The next higher income bracket may be paying 20% of their wages into the government, where as the next higher income 25% and so on and so on until the high income earners are paying in 35% - 39% of their income.
Now under the Socialist – Marxist Stimulus law that Obama rammed down our throats, some tax credits and tax deductions are phased out for citizens of a certain income level and above. A brand new law puts into effect even more inequality under our laws.
That means that our tax code does not treat all citizens equally under the law.
No one would stand for this inequality in any other aspect of our lives or our laws. As a matter of fact we have fought many wars to right these types of injustices.
The only truly fair and equal way would be to abolish the IRS, repeal the 16th Amendment and enact the Fair Tax.
That would make our nation the one true tax haven in the world and create untold millions of jobs as business and capitol rushed to our shores.
