Have you seen Obama’s Birth Certificate? His Certificate of Live Birth, not the Certification of Live Birth seen on his fight the smears website. Has anyone ever seen his actual birth certificate? It would seem there is a growing number of average citizens, Lawyers, candidates and members of the Electoral College who would like to see it as well. There seems to be a consensus of some judges that no one has the right to question a presidential candidates qualifications under Article II Section I of our Constitution.

Reported on several blogs and websites the Berg v. Obama No. 08-cv-04083 suit brought in US Federal District Court for the Eastern District of PA has been dismissed. This has been now confirmed by postings on Bergs Obamacrimes.com website.

Americasright.com reports:

The order and memorandum came down at approximately 6:15 p.m. on Friday. Philip Berg's lawsuit challenging Illinois Sen. Barack Obama's constitutional eligibility to serve as president of the United States had been dismissed by the Hon. R. Barclay Surrick on grounds that the Philadelphia attorney and former Deputy Attorney General for the Commonwealth of Pennsylvania lacked standing.

Update 10/24/2008: It appears that the court website that posts all court filings and rulings in PDF format is no longer allowing viewing or download of documents. I am not sure what this means. Could be a ruling in the case is forthcoming, could mean the judge has gag-ordered and sealed the precedings. According to Berg - Obama and the DNC have by default admitted all of his claims are true. If the contention is true and the court accepts it, it could be Earth shattering.

According to Rule 36 of the Federal Rules of Civil Procedure, a party upon whom requests for admissions have been served must respond, within 30 days, or else the matters in the requests will be automatically deemed conclusively admitted for purposes of the pending action.

On September 15, as part of his federal lawsuit contending that the Illinois senator is ineligible, pursuant to the U.S. Constitution, to serve as president of the United States, Philadelphia attorney Philip Berg served Barack Obama and the Democratic National Committee with just such a request. Soon thereafter, on October 6, Barack Obama and the DNC acknowledged service in their motion for protective order, filed in an attempt to persuade the court to stay discovery. The Federal Rules require that a response to a request for admissions be served within the 30-day time limit, and Barack Obama and the DNC have not done so.

Therefore, this morning, amidst news reports that Barack Obama will be suspending his campaign for a few days so he can fly to Hawaii to visit his grandmother, who has suddenly fallen ill, Philip Berg will file two motions in district court in Philadelphia:

• A motion requesting an immediate order deeming his request for admissions served upon Barack Obama and the DNC on September 15 admitted by default, and
• A motion requesting an expedited ruling and/or hearing on Berg’s motion deeming the request for admissions served upon Obama and the DNC admitted.

This is the part where it gets complicated so follow along closely and remember logic and reason have nothing to do with rules of evidence and court procedure.

Update to post Is Barack (Barry) Obama (Soetoro) A Citizen? CIVIL ACTION NO: 08-cv- 04083

In Mr. Bergs filing with the Federal Dist. court for the Eastern Dist. of Pennsylvania he alleges: Obama was not born on U.S. Soil, the filing claims he was born in Kenya. To a Kenyan national father and a U.S. National mother, who was 18. If he was born in Kenya, his mother would have had to have been 19 years old to claim U.S. Citizenship for Obama at the time of his birth. (Must have lived in US 5 years after age 14)
Even if as he alleges he was born in Hawaii, when his mother re-married and moved to Indonesia she renounced both her and Obama’s citizenship once there. Since that time Obama has never filed the proper paperwork with the U.S. State Dept. to regain said citizenship, if in fact it ever existed. That would make Obama as the filing alleges, an illegal alien who is not only unqualified to run for President, nor could he even be allowed to hold his current U.S. Senate seat.
